These terms and conditions determine how you can purchase, change, recharge, or cancel products, plans, and services purchased from these websites and platforms. By using our platforms or websites, you agree to be bound by us and accept these terms and conditions unconditionally.

Who are we?

HandySIM LTD ("us," "we," or "our," depending on the context) provides online services for searching and purchasing international roaming service plans, whether for data, calls, or text messages. These services are for people around the world through our websites and platforms. 

HandySIM LTD is not a telephone service operator and bears no responsibility for determining and controlling prices in existing options. All products are third-party products and are subject to the terms and conditions of those third parties.

Our websites and platforms are provided by HandySIM LTD, an incorporated and registered limited liability company in the United Kingdom.

You must know and understand the terms below before using our services:

If you use and purchase a product from our platforms or websites, you must ensure that you have understood and read the relevant terms and conditions of the product provider (operator) and that you are familiar with and have read in detail the description of the plans you have purchased.

We are an agent that sells and resells services through our platforms and websites. By using our services, you expressly acknowledge and agree that we shall not be liable to you for these products, plans, and services, as this is the responsibility of the operator (product provider).

All claims relating to these products, plans, and services purchased through our platforms and websites must be directed to the Product Provider (the third party). The products, plans, and services are subject to the terms and conditions of the Product Provider (the third party). 

If you use our platforms and websites, you will also be subject to our privacy policy.  

We may change these Terms at any time at our discretion. If these Terms are changed, we will post the revised terms and conditions, and you will be deemed to have accepted all changes. If you do not accept all of these Terms, you may not use our Websites or Platforms.

We use several definitions and terms that you should be familiar with:

Order Confirmation means the email confirmation you receive from us with a full description of the products, plans, or services you have purchased, how to use them, etc.

Product, plan, or service means a product offered for sale on our websites and platforms. Hereinafter, it will be referred to as PLAN/PLANS for short.

Service provider (mobile service operator) means the third party that manages the product you purchase on our websites and platforms. Hereinafter, it will be referred to as OPERATOR.

Mobile Plan Provider Terms and Conditions means the terms and conditions of the relevant service provider (operator) of those mobile plans that you purchase from us.

Website, platform, and application refer to all types of HandySIM LTD platforms (websites, applications, etc.) that you use to purchase plans, recharge plans, or use our services. Hereinafter, it will be referred to as Platform/Platforms for short.

Our responsibility to you:

We act solely as a company that provides various types of international roaming plans from various  types of Operators (third parties) for all products found on our platforms. Therefore, you acknowledge and agree that: 

We are not responsible for the performance and quality (such as coverage, signal, etc.) of the plans, nor are we responsible if the plans you book do not meet your requirements or are not suitable for you. 

We accept no responsibility for any loss or damage you may incur.

We are not responsible for the information you provide on the platforms (including any email address or contact number you provide when purchasing plans), even in cases where this information is incorrect, incomplete, inaccurate, or misleading. 

We are not liable as a result of any actions, omissions, errors, or failures to perform by any Operator or third party that provides you with the Plans you have purchased through our platforms.

We are not liable if you have to purchase a replacement product due to the actions, omissions, errors, or failures of any Operator or third party that provides you with the original Product(s). 

We are not liable for the use of products for the purposes of your trade, business, craft, or profession (including any loss of profit, loss of revenue, loss of data). 

We advise you that it is your responsibility to ensure that you allow sufficient time to use the product(s) you have reserved. 

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, or for any loss that cannot be excluded or limited under applicable law. 

Our total liability to you for all claims arising from your use of our platforms is limited to the price of your purchase (including all fees) under these terms and conditions.

Products, Plans, and Operators (Product Providers)

Although our platforms allow you to purchase various types of plans and services, they are managed by various international product operators, which are third parties. 

When you use our platforms to purchase plans, products, or services, you unconditionally confirm and agree that: 

The purchase of a plan (package, product) creates a relationship (contract) between you and the relevant service operator, and you expressly undertake to familiarize yourself with its terms of use.

The terms and conditions of each service operator govern the provision of different types of plans and packages and are separate from our terms and conditions, which govern their purchase through our platforms.

Any claims you may have in relation to the plans (products or services) must be made against the relevant operator (service provider), and the performance of the purchased plans (packages or services) is subject to the Terms and Conditions of the Operator (Product Provider). 

By using our platforms, you agree that you have read and understood the Terms and Conditions of the service operator (supplier) relating to the product(s) you have purchased. 

Return and Refund Policy

Regulation 28(1)(h) of the Consumer Contracts Regulations (Information, Cancellation and Additional Charges) Regulations 2013 in the United Kingdom states that contracts for the provision of entertainment services on a specific date (or for a specific period) are exempt from the 14-day "money-back" period imposed on selected online goods and services. The consumer 14-day cooling-off period therefore does not apply to selected services and plans made through our platforms, and cancellation is subject to these terms and conditions.

HandySIM LTD follows the operator's policy (general terms and conditions) for the purchased plan or service. The customer must be aware of and agree to the following before making a purchase:

Once the eSIM has been downloaded/installed on the phone and/or the package has been activated, the customer is eligible for a full or partial refund, as applicable, only if: 

The service does not work or stops working due to a genuine product malfunction or other technical malfunctions in the product or service.

Or no solution to a problem has been provided within 24 business hours after the customer has provided all necessary information to HandySIM LTD at info@handysim.com.

Cancellation – a refund is only possible if the eSIM has not been downloaded/activated, in cases such as:

Incompatible device: The customer's device cannot use the service due to a lack of the necessary hardware or software.

Change of mind: The customer no longer wants or needs the product or service.

Cancellation/return fees will apply in accordance with the operator's relevant policies.

Refund eligibility DOES NOT APPLY in the following cases:

Lack of request for assistance: The customer has not contacted HandySIM LTD to have the situation diagnosed and to receive assistance in activating the service.

Damage caused by the customer: Whether intentionally or accidentally, the customer has damaged/disabled the product (e.g., eSIM deletion, damaged or lost device, factory reset, etc.).

Wrong purchase: The customer has purchased and activated the wrong product by mistake, including cases where the customer is in an uncovered country or does not have coverage on the network specified in the product description.

Partially used products and services: Including cases where the customer has moved outside the acceptable network coverage area.

Dissatisfaction with network performance - before purchasing, it is the customer's responsibility to check the coverage for a given country with the operator!

The above conditions are treated in their strictest form and by using our services you agree to them unconditionally. In practice, the policies of many operators are quite flexible, but it all depends on their terms and conditions. We advise our customers to contact HandySIM LTD support at info@handysim.com, but please note that we may not be able to offer any solution if you are in one of the situations listed above.

DELIVERY

Most products sold on our platforms (such as eSIM profiles, top-ups, data and voice add-ons, etc.) will be delivered immediately, with the relevant information displayed on the screen and communicated to the user by email. The partner service provider may separately inform the user of our platforms through its own systems (such as an SMS message) about the successful purchase of its product.

REFUNDS.

If the Operator charges the user for a service that is not delivered due to a technical or logistical problem originating from the Operator's systems or its service providers, and the Operator is unable to resolve the problem within 48 hours after the user has provided all necessary information about the problem, the user of our platforms is entitled to a full refund. 

The Operator will track and identify such issues through its own systems and will process refunds automatically.

Refunds will be made using the original payment method and will be processed within 10 to 45 days depending on the method used for payment.HandySIM LTD's maximum liability will be the amount paid for the products. HandySIM LTD will not be liable for any damages, third-party costs, or alternative costs that may arise as a result of the service not being delivered or not working as stated in our terms and conditions. 

HandySIM LTD will attempt to mediate between the end user and the service provider, but in no way guarantees that a refund will be possible, regardless of whether the service has been used or not. The company may, at its discretion, decide to refund the user partially or in full.

PERMISSIONS FOR USE

You agree that you are authorized to visit, view and save a copy of pages from this website for your personal use only, that you will not duplicate, download, publish, modify or otherwise distribute the materials on this website/platform for any purpose other than personal use. The content and software on this website/platform are the property of HandySIM LTD. This website/platform may not be used by you for commercial purposes, such as selling goods or services of any kind. You must obtain the prior written consent of HandySIM LTD to make commercial offers of any kind on the site, whether through advertisements, invitations, links, or any other form of communication. HandySIM LTD will investigate and take appropriate legal action against anyone who violates this provision, including, without limitation, removing the offensive communication from the website/platform and prohibiting such violators from using the website/platform.

COPYRIGHT POLICY

HandySIM LTD may terminate the privileges of any user who uses this site/platform for copyright infringement. If you submit information from this site/platform, you warrant that the information does not infringe the copyright or other rights of third parties. Although HandySIM LTD is not responsible for the content, quality or accuracy of the data, compilations of such data, text, information and other materials provided to users through the HandySIM LTD system, the materials are the intellectual property of HandySIM LTD and are protected by international intellectual property laws. Online materials may not be copied or distributed in whole or in part without the prior written consent of HandySIM LTD.

YOUR ACCOUNT

By using the HandySIM LTD website/platforms, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your account from any device, and you agree to accept responsibility for all activities that occur under your account or password. The website is not responsible, directly or indirectly, in any way for any loss or damage of any kind incurred as a result of or in connection with your failure to comply with this section.
